Recording Property Documents in Elkhart County
Any real property instrument for Elkhart land must be recorded with the Elkhart County Recorder in Goshen. Indiana's recording process has three steps. The document goes first to the County Assessor for review and stamping. Then it moves to the County Auditor, who updates ownership in the tax records and endorses the document. Finally, the Recorder records it. Fees are collected at both the Auditor's and Recorder's offices.
All documents must meet Indiana's standard formatting requirements. White paper only, maximum 8.5 by 14 inches, at least 20-pound weight. Font must be 10-point or larger in black ink. First and last pages need 2-inch top and bottom margins; side margins must be at least one-half inch. Names must be typed or printed below each signature exactly as they appear in the signature. A "Prepared by" line is required on all documents. Any Social Security numbers must be removed before submission under IC 32-21-2.
A Sales Disclosure Form must accompany every deed submitted to the Auditor. This form documents the transaction terms and is required for the Auditor to endorse the deed. Without endorsement, the Recorder will not record the document.
Elkhart County accepts e-recording through approved vendors. CSC eRecording (866-652-0111), Simplifile (800-460-5657), and eRecording Partners Network (888-325-3365) handle electronic submissions. This option is particularly useful for lenders and title companies that record multiple documents regularly.
Elkhart Deed Records and Title Research
Deed records in Elkhart County form the core of the property title system for the city of Elkhart. Under IC 32-21-2, a valid deed must include a complete legal description of the property, the names and mailing addresses of both the grantor and grantee, and a notary acknowledgment. The Recorder indexes each deed by both parties' names, creating a searchable chain of title.
Title searches in Elkhart start with the Recorder's grantor/grantee index and trace ownership backward through recorded deeds. Each link in the chain must connect without gaps or competing claims. If a title defect is found during the search, it may need to be resolved through a quiet title action or corrective deed before the property can be sold or refinanced.
Plat maps for Elkhart subdivisions are also recorded with the Elkhart County Recorder. These maps establish lot lines, easements, and street layouts within each development. Plats are public records and available for viewing through the Recorder's portal or by request at the Goshen office.
Elkhart Property Tax and Assessment Records
The Elkhart County Assessor sets assessed values for all taxable parcels in the city each year. The Auditor then calculates the annual tax bill based on those values and applicable rates. Under IC 6-1.1, property owners who believe their assessment is too high can appeal to the county's Property Tax Assessment Board of Appeals. The process involves filing a formal petition within the required time period after receiving the assessment notice.
Tax and lien records are separate but related. The Auditor holds delinquent tax records; the Recorder holds judgment and mortgage lien records. Checking both sources is standard during a title search for Elkhart property. Unpaid taxes create liens that run with the land, not the owner, so they carry over to a new buyer if not resolved before closing.
