Recording Requirements for Fountain County Documents

Indiana law sets uniform recording standards for all counties, and Fountain County follows them without exception. Every instrument submitted for recording must be notarized. The name of each signatory must be typed or printed exactly as signed, directly below the signature line. A "Prepared by" statement identifying the drafter must appear on every document before submission.

Paper and format standards are specific. Documents must be printed on white paper, no larger than 8.5 by 14 inches, with a minimum weight of 20 pounds. Top and bottom margins on the first and last pages must be at least 2 inches. All other margins must be at least half an inch. Font must be 10-point or larger in black ink. Documents that do not meet these requirements are flagged as non-conforming and charged an extra $1 per page on top of standard fees.

The statewide fee schedule under IC 36-2-7-10.5 applies in Fountain County. Recording a deed costs $25. A mortgage is $55. Most other instruments, such as affidavits, run $25. Releases and assignments are each $25. Pages that exceed 9 by 15 inches carry an extra $5 per page. Standard copies cost $1 per page. Oversized copies are $5 per page. Certified copies add another $5 to any copy fee.

Deed transfers require three steps before they reach the Recorder. First, the County Assessor reviews and stamps the deed. Then the County Auditor endorses and transfers it. Finally the Recorder records it. Fees are collected at both the Auditor's and Recorder's offices. Under IC 32-21-2, all deeds must carry a legal description, the grantee's mailing address, and must have any Social Security numbers removed before filing. A Sales Disclosure form must accompany every deed.
